General
This rental contract is directly between the hirer / sender and the owners of the property (Elsa Properties Group Inc.) and incorporates all the conditions set out below.
Authority to sign
The person who sends this electronic Booking Form (the hirer) certifies that he or she is authorised to agree to the Booking Terms and Conditions on behalf of all persons included on the Booking Form . The sender must be a member of the party occupying the property and must be 25 years or over.
Deposit and Payment Balance
A deposit of 25% must accompany bookings. The balance of payment due must be received latest 12 weeks prior to the commencement of the rental. Full payment must accompany the booking if it is less than 12 weeks to departure date. We reserve the right to cancel the booking if full payment is not received by the due date; cancellation charges will apply as set out below.
Refundable Security Deposit
A $500 / (£350) security deposit is required at the time of final payment. This is required to cover the costs of any breakages or excess cleaning requirements. Security deposit will be refunded within 14 days of departure, less damage costs (if any).
Cancellation
1. Written notification must be given by the original sender in order to cancel your booking. Cancellation date will be the date written notice is received. Cancellation by hirer will result in you being liable for the following charges :
Period before arrival at Villa Sea Pearl:
26 weeks prior to arrival date - Loss of Deposit
6 - 10 weeks prior to arrival date - 50% of rental
4 - 6 weeks prior to arrival date - 75% of rental
Less than 4 weeks prior to arrival date - 100% of rental
Hirer to ensure they have adequate travel insurance to cover themselves against such eventualities.
2. In circumstances beyond our control, we reserve the right to cancel your booking. In such circumstances, we will do our utmost to find alternative accommodation or refund your money in full. No compensation will be made due to cancellation or changes due to war or terrorist acts, natural disasters, threats of riots, fire and adverse weather conditions or acts of God. Hirer to ensure they have adequate travel insurance to cover themselves against such eventualities.
Hirers Obligation
The hirer agrees to pay for any breakages, losses or damages to the property incurred by the party during their stay at the property. In the event damages are greater than the deposit, the hirer agrees to settle any additional costs incurred. Any charges incurred in obtaining settlement of additional costs will also be for hirer's account.
Party Size
Everyone occupying the property must be listed on the booking form, including small children and infants. This is Florida State Law and must be complied with. Villa Sea Pearl is fully licensed for short-term rentals in Florida up to a maximum of 12 persons. The owners reserve the right to refuse admittance if this condition is not met. Pets are not permitted on the property.
Disclaimer
The owners decline any responsibility for any loss, accident or mishap to persons or property whilst on the premises or whilst engaged in any activity there from / thereon, or any illness arising from any cause whatsoever. The hirer acknowledges and confirms and accepts same on behalf of all persons booked for. A broadband connection is provided for guests free of charge, guests must supply their own computer and it is the guests' responsibility to ensure they are able to connect.
Smoking / Open flames
For the safety and comfort of all guests : smoking and BBQ'ing are NOT permitted within the property or caged deck area. A special BBQ area is available to one side of the villa. Guests to ensure they switch on the villa security alarm system any time they exit the villa.
Parking
Formosa Gardens Estates has a covenant forbidding motor homes / rv's etc. Guests who arrive with motor homes / rv's must park such vehicles outside the estate, and may find that if they choose to ignore this condition, the Home Owners Association will have such vehicles removed at guests' expense. Guests are requested to park on the driveway, not on the road / grass verges. Please take care NOT to park on the azelea bushes beside the driveway. The garage is NOT available to park cars in.
INSURANCE ADVICE
We strongly recommend that hirer ensures their party have adequate travel (including cancellation) and medical insurance prior to your departure from home, due to the high costs of legal and medical expenses in Florida.
